Re: Tavares vs CRA
2 other points I failed to mention which may be argued by CRA:
- signing bonus is treated the same salary for cap purposes;
- signing bonus is subject to escrow just like salary.
Thus, CRA will argue, Tavares did not get the full amount and it is just another name for salary.
Also, apparently CRA is arguing that Tavares was a resident of Canada as of July 1, 2018 when he signed the contract. The season ended for Tavares in April and so the facts around WHEN he became a resident of Canada will be very important
- Was he house shopping or buying?
- When did he get a new driver's license, bank account, gym account etc.
Where was he physically living from April thru July 1st.
