It wasn't written into the contract. If a player waives the no trade clause, it is up to the other team whether to honour it. In Subban's case, he was traded two days before his no trade clause actually kicked in, so Nashville had the option to honour it or not.
Some teams might choose to honour it as a way to entice players on other teams to agree to waive no trade clauses in the future as you are showing loyalty right off the bat.

I suppose that would limit the teams who could add him at full price and therefore the return but for a RHD who can still play at a high level it still seems like a bargain.

If it was any other team I would say 10M, but in Nashville with Poile, I think we could see him take $8.5M. Nothing wrong with similar numbers to Stamkos, Draisaitl, or Carlson.

Or maybe I'm just pissed as a Flyers fan watching the f'n Devils rise up from the landfill of north Jersey. While Philly signs 2nd and 3rd liners sweet money/term contracts and waits for G and that guy who always needs to shave and maybe pass a few seconds sooner to get past their prime and lose all trade value as well as on ice value.
