Not sure on how legal that is but i\'m sure that this situation must have been thought of and closed in the CBA somewhere.

In theory, what is there to prevent Radulov from \"retiring\" from the nhl and then going to play in the KHL?
If he doesn\'t want to come back to the nhl then what does he care if he retires.
The IIHF would probably have a problem with it but why wouldn\'t he do this if he already doesn\'t care about being suspended from international competitions?
He probably has a better legal case if he does it that way.
Assume he does retire and then wants to come back to the nhl he\'d have to wait at least a full year and his rights would probably still be owned by the preds.

All I can reference is the Palffy situation.
Aug 05 - signed a 3 year deal with Pit
Jan 06 - retires
Jul 07 - signs with home town euro team
The contract with Pit should have ended after 07/08
There was a gap of more than a year from when he retired to when he signed to play again.
And the other thing was that his shoulder was injured at the time of his retirement but officially he retired due to personal reasons.
i would imagine in cases like Palfy\'s where they\'re actually retired for a period of time, the leagues would look more favorably. Rather than obviously retiring as a means to break your contract. Legally it may make no difference though

palffy retired because of injury, long term injury retirements are a special case under the CBA, exploited well by lamoriello.
