Unreal.
I would love to see Bettman's face if/when he hears the news that JB's bid is accepted. How can they not accept the bid when its almost twice as much as the next highest? Is it totally up to the Coyotes owners which bid wins? (if JB ends up being allowed to bid that is). I am not going to study the legal crap so maybe someone who knows it can chime in here...
If only Winnipeg was a viable option...*sigh*
I don't think you'll get to "see Bettman's face if/when he hears the news that JB's bid is accepted."
From what i understand, the current NHL owners voted unanimously against having Balsillie as an owner of any team in this league. You may not like bettman, but at the end of the day, he's just the errand boy of the 29 team owners (Moyes got kicked out of the club per the by-laws when he declared bankruptcy).
So the fact that the NHL and Bettman are fighting this, is a sign that the NHL owners don't want balsillie to be an owner.
Here's the thing: A bankruptcy judge in the united states, does not have technically have the authority (as far as i'm concerned) to undermine the lawful constitution of an international corporation. A U.S. judge doesn't have the jurisdiction or the authority to mandate that any unit be moved to a different country (which would be the case if they accepted Balsillie's bid... they'd basically be saying that Balsillie can move this team to Canada... but that's canada's decision to make). The NHL has specific rules pertaining to how teams can be bought, transferred, owned, etc... (all of which Balsillie is violating by taking this route of acquisition).
The judge is not going to deem anyone as owner of this team when it 100% violates the rules of the NHL as an organization.
==========
Bottom line is... that at the end of the day, the NHL has the power here... the by-laws have strict rules, and if Balsillie is magically awarded this franchise by a U.S. bankruptcy judge, the NHL has the power through said constitution to remove the coyotes from the league if the current owners are indeed that dead set against him.
So Balsillie could pay hundreds of millions of dollars for this team, and move them to hamilton, end up having no competition... source of income... or even NHL players to fill his roster. He'd basically have to join the AHL or something along those lines, because the NHL doesn't want him.
Meanwhile, by simply removing the coyotes... after having balsillie pay the city of phoenix the necessary compensation fees, the NHL could simply "expand" by one team, with much less cost/damage than if they were to give up on phoenix completely. So balsillie would be helping them... and still wouldn't have his NHL team... and lose millions in the process...
This is what could happen... if the NHL wants to take this all the way...
------------------------------
i really don't see any winning scenario in the cards for balsillie. As long as the organization doesn't want him, no extent of money, lawyers, judge decisions will get this guy a team.
My 2 cents.
