An interesting article (to some) about how several of Utah's top choices (according to sources) have run into trademarking problems:
1. Utah Yetis was denied by the US Trademark office due to potential confusion with Yeti Coolers
2. Utah Blizzard and Utah Venom also denied --> no details as to why here.
3. Utah Hockey Club was not trademarkable because it is not distinguishable
"Mammoth" and "Outlaws" did not face any challenges.
I would think the NHL would push the team to finalize a name soon so it is set before the start of the offseason. That would give time to print jerseys, branding etc.

I don't know if I'd agree with the articles headline that the Yetis name has been refused, it sounds like it has been flagged by the trademark office and requires them to submit evidence to overcome the office's objections which are routine. The USPTO I would think cast a pretty broad net regarding confusion and it will be up to Utah to argue that the marks wouldn't be confusing for those products. It appears the office has not really seriously considered their best arguments at this stage. It could be an uphill battle, and they could still probably divide their application and register in the short term their mark for the core aspects of the business that have nothing to do with YETI coolers and whatever else they do, but you do wonder if they might just decide it's not worth the time and effort when Bettman and Co will be pushing them to have a name ASAP.

If I recall, the dividing line is the chances of an ordinary consumer being confused as to whether the cooler company and the hockey team are in the same business. Or something reasonably close to that. I'd have to think that as long as Utah HC does not sell drinkware products, they should be good. It seems likely that the the trademark application probably listed a whole bunch of business areas that the hockey team is going to be involved in (hockey, licensed clothing, licensed sporting goods, licensed home goods, etc.) and the YETI trademark probably overlaps on one of those areas. A real IP attorney would know, but I'd think that a revised application that does not seek the TM for the kinds of products that YETI already makes should help. Or a giant check to YETI. The answer to all of your questions is one thing: money.
Yeah IMO they can likely register Yetis for hockey games services/goods if they want but I wonder if they scrap the idea because of the potential pain of getting all of the merchandise goods categories approved either now or later. YETI may or may not care about it but the USPTO might still step in to prevent it. They are still at a pretty early stage and this can turn into a protracted years long battle in front of these registrars and/or the courts so I wonder if they turn elsewhere to an easier name to eventually register. They will want to begin using the name and logo as promised next season (you can in theory begin using before it registers), so I can't imagine they will wait around to see what all of these unpredictable rulings yield.
