    I don't really know what is accepted by the NHL in a trade, but maybe they could put some conditionnal pick to cover the risk of his injury/surgery

    For example :
    NYR : Kravtsov + Schneider + 1st pick 2022 (If Eichel play 60 games in 2021-22 season) + 1st pick 2023 (If Eichel play 60 games in 2022-23 season)

    seems to me that buffalo should let eichel get the surgery regardless of the trade situation

    likely scenarios (maybe no4 isn't so likely)

    1. buffalo doesnt let him get the surgery, he doesnt play, trade value continues to decrease
    2. buffalo lets him get the surgery, healthy and rehab increases his value and buffalo likely gets its asking price
    3. eichel continues to ask for trade, buffalo stands pat, scenario 1 plays out
    4. eichel retires, gives up his contract, gets surgery, comes out of retirement, signs to a new team to a massive deal

    i found some interesting data for when kovy retired to go to the khl. so you are right, here's the low down
    - players can retire at any given point. their name stays on the "retired" list for 1 full year - if player wants to return within that year, needs permission from all NHL teams. But the team that the player retired from can transfer them back to the "reserve" list for up to 3 years after retirement. So if the player wants to return within that 3 years, needs that 1 NHL team's permission. After 3 years of not playing or after turning 35, the player can come out of retirement on their own free will

    easier way to read it:
    eichel retires
    wants to return within 1 year, needs every NHL team to agree
    wants to return within 3 years, needs BUF approval
    after 3 years, good to return with no approval

    Eichel definitely can't retire and then come back to a new team.

    But he can retire, get the surgery he wants, and then attempt to come back from retirement.

    After listening to the surgeon talk and talking to a bunch of doctors I know, I personally hope Eichel chooses to retire over getting the surgery the Buffalo team doctors want him to.

    according to the CBA, Jack Eichel does not have the final say in what surgery he gets to fix the herniated disc in his neck. This is the lynchpin in the whole issue, the Sabres recommended rest and rehabilitation and when that did not work to alleviate the issue, the team doctors recommended the fusion procedure over the ADR that Eichel and his camp want.

    hmm, this is interesting. retiring is not preferred i would imagine, theres many years left at 10m per left for jack. no doubt the NHLPA will be involved but will jack continue to get his signing bonus/salary if this leaks into next season and he still prefers the surgery he wants vs the one his team wants?

    what a headache lol

    Does NHL contract really say that player X can’t attend to their health the way they want unless team agrees? I understand NHL teams own players “ hockey game” but do they really own their lives?…. There should be a clause that he can do what he wants and not get paid for time he misses…

    There hasn't been something like this in the modern NHL that has been as public, so I wonder if this creates some clauses in future contracts saying something like "Disagreements will go to a third party medical opinion"

    theres still time for teams that really want him to get a bit more serious with their offers . kudos to Adams for standing firm on his price and not getting rattled by outside forces .

    It's already in the CBA, so a contract couldn't have that clause. This probably becomes a contentious issue next CBA though.
