As far as I know the arbiter is still not permitted to consider the cap when making a ruling. On-ice performance and comparable peers are the only factors in the arbitration process. Who's Mikheyev's peer though?

There is very little precedence and I wouldn't be betting much of anything on a 39 game sample. When there isn't much to go on, typically one would err on the side of caution.

Exactly right.
Mikheyev's a solid player, don't get me wrong. But based on a 39 game sample, I think he will be lucky to get more than 2m this season. Leafs hoping for 1.5.
