Should be a suspension. Can't credit a guy for failing to connect (by a whisker) with a deliberate swing of the stick to the head.
That's not to excuse the punch to the back of the head that preceded it. But you just can't have head hunting stick swinging in the game under any circumstances.

You want to punch Malkin in the back of the head when he's defenseless, you can expect a stick to the face. That's what I take away from that.
I'm not defending the action and I don't think there's any place for stick work like that. I do understand the mindset of how a star in the NHL could take it upon himself to protect himself when the refs consistently miss calls (I know they're human) and the league does virtually nothing to protect them. These top end guys are physical targets game in and game, often by a bunch of guys struggling to stay on the league. It's not fun to get punched in the back of the head while playing hockey nor is it a price that should just be expected that you should have to pay just because you're really good.
Look at what mcdavid has to put up with every night (he's nowhere near the only one, just the most obvious when you watch the games). I can see a guy getting fed up once in a while, it's amazing it doesn't happen more.
This is a league problem in my opinion. Protect your star players for the millionth time. All the other professional sports leagues do it.

Yeah. Amazing how the 2 referees miss those 3 infractions while Malkin had the puck, but caught the swinging stick when he didn't have the puck. What are they watching? Why not give Raffl a penalty on the play as well? Just shows me how much control the referees have, and not in a good way. It just seems a little too personal to me. One guy will get away with just about everything as long as he doesn't complain, then the guy that retaliates, gets nailed. Probably because he said something to the ref's earlier in the game. Seems to happen too often. Not that he didn't deserve the match, but....
The NHL doesn't know what it wants. On one hand they want to call penalties to encourage skill and scoring. On the other hand OMG we can't call a bunch of penalties against the same team and OMG we goofed over here so we have to do make-up calls and OMG it's the third period so we can't mess with the outcome of the game. Then you get situations where a guy gets pissed off.
And no, fighting would not help. The no-talent goon would be glued to the bench while Malkin is getting abused.
